House of Representatives
Session of 2015 - 2016 Regular Session

MEMORANDUM

Posted: January 12, 2015 09:50 AM
From: Representative Ryan E. Mackenzie
To: All House members
Subject: Tax Collection Fraud Prevention Legislation (Previous Amendment 07251 to HB 1590)

Please find attached a copy of legislation I plan to introduce that seeks to amend the Local Tax Collection Act by prohibiting checks collected by a Tax Collector from being made payable in the name of an individual. Taxes may still be made payable to the name of the office, title or position.

Many times when we hear stories about a tax collector committing fraud it is the result of a tax collector depositing public monies into their personal bank account. By changing how checks from taxpayers are made out, this bill would reduce the possibility of fraud.

I offered this exact language last session as Amendment 07251 to HB 1590 and it passed the House unanimously. This amendment and other provisions were only later taken out by the Senate before the bill was sent back to the House for final passage.

I believe this legislation will give municipalities and taxpayers an added layer of protection by ensuring their tax dollars go where they are intended. Please join me in co-sponsoring this important piece of legislation.
