I plan to re-introduce legislation from last session, HB 1388, that would increase the current DUI penalty structure in Title 75 (Vehicles). My proposed changes are to 3rd and 4th time offenders for the .10 to .159 percent tier and to the .16 percent and higher tier 2nd and 3rd time offenders, as well as adding for 4th time offenders.
- Increase fine from the current $1,500-$10,000 range to a range of $5,000-$10,000. - The current mandatory ignition interlock penalty would increase from 1 to 2 years. * The 4th and subsequent offense penalty changes include: - Increasing grade of penalty from a 1st degree misdemeanor to a 3rd degree felony. - Increase fine from current $1,500-$10,000 range to a range of $10,000-$15,000. - Increasing license suspension from 18 to 24 months. - Increasing current mandatory ignition interlock penalty from 1 to 5 years.
