Subject: Requiring Notice of Vehicle Recalls
 
In the near future, I will be introducing legislation that would require auto dealerships to disclose unperformed manufacturer recall work before selling a used car. This is an effort to avoid tragedy when a consumer purchases a car with serious known defects.

There are no universal laws regarding recalls and liability on used cars. Dealerships, either knowingly or unknowingly, are putting vehicles up for sale with outstanding recall work. This can have deadly results.

The legislation will require dealers to determine from the vehicle's manufacturer whether or not any unperformed manufacturer recalls exist on the vehicle. If so, the dealer would be required to disclose to the purchaser in writing, prior to sale, details of those recalls.

If the vehicle has outstanding recalls for which the manufacturer will reimburse the dealer, the dealer must perform or enable to be performed the work not later than 20 days after the sale to the buyer.
