MEMORANDUM

To: All House members
Subject: Amending the Local Tax Collection Law to add a time frame for the turnover of records

In the near future, I will be introducing legislation amending the Local Tax Collection Law to add a 30 day time limit for outgoing tax collectors to turn over their records to the newly elected or appointed tax collector or taxing district. The current law does not stipulate how quickly the outgoing tax collector needs to turn over their records but only states that the tax collector may not refuse to transfer possession of the records.

I feel that adding a 30 day time limit and clarifying that if the outgoing tax collector does not turn over the records within this time frame that they may be taken to court to facilitate the prompt transfer of records thus enabling new tax collectors to do their job as efficiently as possible.

Thank you in advance for your consideration and support.

Introduced as HB2166
