MEMORANDUM

Posted: February 12, 2014 04:34 PM
From: Representative Nicholas A. Micozzie
To: All House members
Subject: Repeal of March 26, 1903 Act Requiring Railroads with Railroad Track Under Viaducts and Bridges to Pay Maintenance Fees

In the near future, I will introduce legislation which repeals a redundant law from March 26, 1903.

The current law requires a railroad to contribute to maintenance costs of bridges or viaducts before it can run its lines of track under the bridge or viaduct. The railroad must also enter into a contract with the municipality to continually pay a portion of ongoing maintenance fees.

My legislation would repeal this entire provision of the law, because this provision can be found elsewhere in other Pennsylvania Statutes. Please join me in sponsoring this piece of legislation.

Thank you for your consideration.

Introduced as HB2368
