Subject: | Prohibiting Use of Open Impoundments for Storage of Produced Liquids, Treated Water, Hydraulic Fracturing Fluid, or Industrial Waste |
As we continue to monitor the development of our natural resources, we need to further refine our protective measures to help safeguard our residents and natural environment. Therefore, tomorrow, Friday, June 14, 2013, I plan to introduce legislation prohibiting the use of open impoundments for the storage of produced liquids, treated water, hydraulic fracturing fluid or industrial waste. Under this bill, fresh water may be stored in an open pool, but these other fluids and wastes must be managed through the use of closed containment or closed loop systems. While many companies already utilize closed containment or closed loop systems, others do not. This bill will dictate their use. This legislation will make the procedure mandatory and, ultimately, will help to ensure that no harmful fluids escape containment where they could then become a threat.
