Subject: Legislation Adding to the Definition of Processing in the Tax Reform Code
 
In the near future, I intend to introduce legislation that would amend Section 201 of the Tax Reform Code to add the crushing, milling and sizing of fused aluminum to the definition of ‘processing’ in the Tax Reform Code.

It is vital that we not place companies that produce products from the crushing, milling and sizing of fused aluminum at a competitive disadvantage. In my legislative district, U.S. Electrofused Minerals, Inc. has been a wonderful success story since it relocated to Aliquippa over a decade ago. U.S. Electrofused Minerals, Inc utilizes crude brown fused aluminum oxide and refines, crushes, mills and sizes the resulting grain for use in sandblasting, sandpaper, refractory and anti-skid materials industries. This economic driver in my district is directly responsible for 23 family sustaining jobs. Recently, a Department of Revenue decision found that this operation did not qualify as a manufacturer under the Tax Reform Code. This legislation will ensure that major employers, like the one in my district, is not being undercut by similar plants in states that do not place a sales tax on this type of manufacturing.

Good paying, family sustaining jobs are at a premium nationwide. We cannot allow a questionable regulatory decision to place this industry at a competitive disadvantage. Please join me in supporting this legislation which will allow businesses such as U.S Electrofused Minerals, Inc to continue providing an economic engine for the Commonwealth.
