I will soon introduce legislation to amend the Wiretap Law. This legislation was recommended by a constituent to address the significant growth in the use of home security systems. Many homes in Pennsylvania have installed and utilize home security systems or doorbell security systems including Ring, Nest, SimpliSafe and many other systems. The systems record video and audio of specific areas on or near a home when movement is detected. The legislation that I am introducing will amend the Wiretap Law to make it clear that interceptions of electronic or oral conversations incidental to the use of a home security system installed on a person’s home are not violations of the Wiretap Law. The proposal requires homeowners take reasonable measures to ensure privacy protections that account for neighborhood density and the structure of housing including shared walls, driveways, and other structures. The legislation will also limit the protection to capturing video and audio of conversations on a person’s personal property. Distribution of audio and video of conversations recorded by home security systems shall be prohibited unless distribution is made to law enforcement for purposes of investigation.
