Subject: Reducing the Statute of Repose of Construction Projects
 
In the near future, I will be re-introducing Senate Bill 833 of last session. This legislation reduces Pennsylvania’s current statute of repose for construction projects from twelve years to six years.
 
Statute of repose defines the time period after completion of services during which legal action may be brought against architects, engineers and contractors.
 
This legislation will reduce the chance for frivolous lawsuits against architects, engineers and contractors for issues that arise over a decade after construction due to poor maintenance or renovations to the original building design. Six years offers ample opportunity for building owners to identify design and construction deficiencies and to hold the appropriate parties accountable.

Colorado, Delaware, Massachusetts, North Carolina and Washington are a few states that have adopted a six-year statute of repose for construction projects.
