Subject: | Mobile Retail Food Facility Licenses - Heffley |
In the near future I intend to introduce a bill amending Title 3 (Agriculture-Chapter 57) that will allow for a mobile retail food facility that operates in more than one licensing jurisdiction to have a single license. In addition to the Department of Agriculture, there are multiple county and municipal health departments that license retail food facilities. The operator of a mobile food facility (like a French fry or funnel cake truck at a fair or carnival, or a hot dog cart that operates on the street) is currently required to have a license for each jurisdiction in which he/she operates. Licensing fees are not consistent among local health jurisdictions and multiple licenses can be a financial burden to the mobile retail food facility operator. My legislation will require one license to be issued by the jurisdiction where the mobile retail food facility has its base of operations. The mobile retail food facility may be inspected by officials in another licensing jurisdiction, but no fee for such an inspection may be levied.
