I plan to re-introduce legislation that would amend the County Code to grant county commissioners the option to eliminate the office of jury commissioner. This legislation applies to second class A or third through eighth class counties. The Pennsylvania Supreme Court recently ruled in PA State Association of Jury Commissioners v. Commonwealth of PA (Mar. 14, 2013) that Act 108 of 2011 violated the single subject rule of Article III, Section 3 of the Pennsylvania Constitution. Part of Act 108 was comprised of amendments to the County Code granting county commissioners the option to eliminate the office of jury commissioner. Forty-two counties adopted resolutions abolishing the office of jury commissioner pursuant to this Act. This legislation will reinstate the ability of counties to abolish the office. If the office is eliminated, jury commissioners in office would serve the duration of their term which is through December 2013. |
