MEMORANDUM

Posted: June 20, 2018 02:09 PM
From: Representative Rick Saccone
To: All House members
Subject: Co-Sponsorship - Cosmetology Salon Variances and Booth Rental

In the near future I will be introducing legislation to amend the Cosmetology Law (Act 86 of 1933) to further clarify the issuance of variances by the State Board of Cosmetology, and to provide for a clearer definition of booth rental.

Under its regulations, the State Board of Cosmetology has the authority to grant variances for the minimum floor space required in a salon. My legislation clarifies that when a salon owner moves or vacates the salon, any variance previously granted shall be void and a new request must be submitted to the Board. My legislation also adds language to make it clear that booth rental, which is prohibited under the Cosmetology Law, means the renting or leasing of any space to a licensed cosmetologist where that space does not meet the requirements of a salon as set forth in the regulations of the Board.

My legislation protects consumers, small businesses, the integrity of the industry and the individuals who work in salons.
