Subject: 10 Acre Exemption
 
In the near future, I plan to introduce legislation amending our Pennsylvania Sewage Facilities Act (Act 537 of 1965) to better ensure that our local governments are upholding the “10 acre exemption.”

Since its passage, Act 537 has always recognized the different nuances of permitting septic system in rural PA, particularly on larger tracts of land. In fact, in 1989, we clearly provided that “no permit or plan revision shall be required for the installation of an individual on-lot sewage system for a residential structure occupied or intended to be occupied by the property owner or a member of his immediate family on a contiguous tract of land ten acres or more.”

However, it has come to my attention that some local agencies or municipalities are not upholding this 10 acre exemption. Accordingly, my legislation will extend the existing $300/day penalty for municipalities that fail to submit or implement their official plans to cases where the local government is not upholding this important exemption.
