In the near future, I intend to introduce legislation that will give the General Assembly a greater oversight role in the regulatory process. Given ongoing concerns regarding the impact of regulatory burdens on job creation and the lives of Pennsylvanians, this legislation is particularly timely. My proposal is modeled after the proposed federal REINS Act (Regulations from the Executive in Need of Scrutiny Act). REINS Act legislation passed the U.S. House in January. This federal legislation requires Congress to approve all new major regulations before they can go into effect. Under the federal REINS Act, a major regulation is one that imposes $100 million or more in costs on the economy. Like the federal proposal, my legislation will establish an enhanced review process for major regulations that impose a substantial cost burden on the Commonwealth. A major regulation – or economically significant regulation – is defined as having an impact on the state, municipalities and/or the business community of $1 million or more per year. Under my bill, the General Assembly will be required to vote on a concurrent resolution to approve an economically significant regulation, in order for that regulation to go into effect. Specifically, if IRRC has approved the regulation or the agency has decided to implement the regulation without IRRC’s approval, a concurrent resolution is introduced in the legislature and must be considered and passed by the House and Senate. I believe that this legislation will enhance regulatory review by giving agencies additional incentives to engage the legislature throughout the process.
