MEMORANDUM To: All House Members From: Rep. Eddie Day Pashinski Date: January 22, 2015 Subject: Prohibiting the Sale of Alternative Nicotine Products to Minors In the near future I plan to introduce legislation to prohibit the sale of alternative nicotine products to minors. Such products would include electronic cigarettes, nicotine gum, and nicotine patches. Over the last few years, alternative nicotine products, such as electronic cigarettes, have been growing in popularity. Although electronic cigarettes are tobacco-free, these and similar products contain nicotine, which should be kept out of the hands of children. Currently, 41 states and the Virgin Islands have enacted laws to prohibit the sale of such products to minors. My legislation amends Title 18 (Crimes and Offenses), section 6305 (relating to the sale of tobacco products) to include alternative nicotine products among items prohibited from being sold to individuals under 18 years of age. In addition to electronic cigarettes, my language includes liquid nicotine, nicotine gum, nicotine patches and related items as products prohibited from being sold to minors. This bill is similar to legislation that was introduced last session—former Senate Bill 1055 of 2013. Protecting our children is a top priority. Treating the sale of addictive alternative nicotine products like sale tobacco products is another way we can ensure the health, safety and wellbeing of Pennsylvania’s youth.
