Subject: Window Tinting
 
In the near future, I will introduce legislation which further provides for sun screening or window tinting on vehicles.

Currently, the Commonwealth adheres to the federal standard (FMVSS-205) for window tinting and light transmittance. This standard lays out clear guidelines concerning window tinting applications and tinting levels for states. The federal specifications state that window tinting may be applied to any and all windows of passenger cars provided the light transmittance level does not go below 70 percent. Title 67 of the Pennsylvania Code mirrors this regulation.

I feel that in some cases, an individual may fall victim to being sold a vehicle with sun screening or tinted windows which does not comply with our laws. It is through no fault of the intended purchaser that this occurs, yet they are being punished by law enforcement as a result.

My legislation will require a seller to remove any sun screening or other material which is prohibited before the sale or transfer of the vehicle. If a retail automotive dealer fails to comply, they are liable for any fines and penalties incurred by the purchaser or transferee. While a private seller would not be liable for the fines, they could be fined $25.
