It has come to my attention that a county Office of Probation and Parole in my area was allowing defendants sentenced to community service to "purchase" credit towards that service by giving gift cards to the Office of Probation and Parole. The plan was for the office to then donate the gift cards to local community groups, such as food banks. However, over $4,000 in gift cards was recently found in a safe in the office. Upon this discovery, the county's President Judge immediately stopped the practice. A previous President Judge of the county had approved the program after he determined that there is nothing in the Judicial Code that prohibits this practice. Unfortunately, it appears that conclusion is correct. Therefore, I will be introducing legislation to specifically prohibit those sentenced to community service from purchasing credit towards that service in any form, including gift cards, cash or other forms of remuneration.
