Subject: Railroad Employee Safety Legislation-Positive Identification of Railroad Employees and Not Requiring Locomotive Engineers to Produce Their PA Driver''s License on Demand in the Event of an Incident
 
I am introducing a package of legislation consisting of 4 bills dealing with the safety of railroad employees.

The fourth bill is POSITIVE IDENTIFICATION OF RAILROAD EMPLOYEES AND NOT REQUIRING LOCOMOTIVE ENGINEERS TO PRODUCE THEIR PENNSYLVANIA DRIVER'S LICENSE ON DEMAND IN THE EVENT OF AN INCIDENT. Currently, the only identification an engineer is required to carry is a card issued by the railroad that does not have a photo. For this reason, in a lot of cases, when involved in a train accident local police officers ask for the engineer's PA driver's license to properly identify the engineer. Then in some instances PennDOT is made aware of the incident and the engineer is charged as if it is a vehicle accident. This legislation would require photo identification for all railroad employees, and when operating a train, a railroad crew is not required to exhibit a PA driver's license on demand to a local police officer.

This legislation was HB 1738 in prior Session 2011-12.
