Subject: | Protection for Landowners who allow Hunting on their Property |
In the near future I will be introducing legislation ensuring landowners are not held responsible for hunting violations committed by those granted permission to hunt on their land. Section 924 of the Game and Wildlife Code (Title 34) may be interpreted to mean a landowner is legally liable for the actions of someone else who the landowner has allowed on the property. Although landowners may give instructions with respect to use of their property, it is unreasonable to expect continuous monitoring for purposes of compliance. Similar to current law (Act 586 of 1965) limiting liability for landowners who allow use of their property for a broad range of recreational purposes, including hunting, this legislation will likewise clarify the landowner liability issue under the Game and Wildlife Code. |
