Subject: Prohibition Against Requiring Electronic Rental Payments (HB 2648 of 2011-12 Session)
 
I am reintroducing legislation, former House Bill 2648 (Josephs), to amend the Landlord and Tenant Act of 1951 to prohibit landlords from requiring tenants to make rental payments electronically.

It was brought to our attention that some management companies include language in their leases requiring residents to make rental payments electronically. This requirement discriminates against tenants who are not computer literate or do not have computers or internet access. Furthermore, it puts residents involuntarily at risk for identity theft.

Current law does not specify how rent may be paid. Therefore, under this legislation, landlords would be required to give tenants one rental payment option that is neither cash nor a form of electronic funds transfer.

Tenants should not be forced to make rental payments using a method that may be inconvenient, costly, or risky for them.
