Subject: COSPONSOR MEMO – Updating Transfer of Disciplinary Records in the School Code
 

Students transfer between schools on a daily basis across the Commonwealth.  The School Code includes provisions for the transfer of student information between school districts, charter schools, and other schools to provide the receiving school with information needed to meet the needs of the student and ensure proper placement. 
 
School and student safety is a primary concern for students, parents, teachers, administrators, and the community.  Section 1305-A of the school code provides for the transfer of student records in the circumstance that a student has had disciplinary issues:
 
Section 1305-A.  Transfer of Records.--Whenever a pupil transfers to another school entity or nonpublic school, a certified copy of the student's disciplinary record shall be transmitted to the school entity or nonpublic school to which the pupil has transferred. The school entity or nonpublic school to which the student has transferred should request the record. The sending school entity or nonpublic school shall have ten (10) days from receipt of the request to supply a certified copy of the student's disciplinary record. The requirements of this section apply as well to transfers between schools within the same school entity.
 
This language needs to be revised to keep in step with the ability and need to transfer information in a more timely manner. 
 
With this in mind, I will be introducing legislation that will update Section 1305 of the school code and related provisions to require the transfer of a student’s disciplinary record at the time of enrollment in a new school.  This will ensure the receiving school has information regarding previous discipline issues up-front to ensure proper student placement, and is aware of any needs of the student at the time of enrollment.
