Subject: | Unemployment Compensation Overpayment |
Pennsylvania workers have faced enormous challenges during the COVID-19 pandemic. They have lost jobs, feared for their health and the health of their family, and have suffered great financial hardship. Should they receive an overpayment of unemployment benefits due to an error they did not cause, they should not have to repay it while the COVID-19 declaration of disaster emergency is ongoing. I plan to introduce legislation prohibiting the Department of Labor and Industry from requiring repayment of an overpayment in benefits when it was made through no fault of the claimant. Exceptions will apply should it be found that the overpayment was made due to a claimant’s false statement or when the claimant fails to disclose pertinent information. The department may collect overpayments beginning 60 days after the termination of the declaration of disaster emergency. Unemployed workers have been stretched beyond their limits over the past year. We must assist them in every way possible.
