Subject: Mine Subsidence Insurance for Home Buyers
 
Please take a moment to imagine that you or your family recently bought a new home, but are now faced with a foundation that has cracked and sunk six inches into the ground due to mine subsidence. Sadly, many homeowners in Pennsylvania are faced with this unfortunate situation because they are not properly informed by the seller or real estate agent that this could happen.


Due to the industrial mining heritage of the Commonwealth, some homes have been and continue to be built above former mines. However, currently, there are no regulations requiring that prospective home buyers be made aware that mine subsidence insurance is available or recommended to them. It is for this reason that I plan on introducing legislation that would require that a homer buyer be made aware of the existence of mine subsidence insurance, which is offered through the Pennsylvania Department of Environmental Protection, when purchasing a home located in an area in which anthracite or bituminous coal or clay mining activities have occurred.

While this legislation would not place a financial mandate on prospective home buyers, it would require that this vital information be made available to them so that they may make a well-informed decision and possibly avert a financial hardship in the future.
