Senate of Pennsylvania
Session of 2023 - 2024 Regular Session

MEMORANDUM

Posted: January 8, 2024 10:29 AM
From: Senator Jimmy Dillon
To: All Senate members
Subject: Worker Protection and Labor Law Non-Compliance List

Pennsylvania workers are the backbone of our economy.  We are obligated to protect them from unfair or unjust treatment when working in our great Commonwealth.  That’s why I plan to introduce legislation that would codify the Department of Labor & Industry’s Worker Protection and Labor Law Non-Compliance List into statute.

The Non-Compliance List was established after Governor Wolf signed Executive Order 2021-06.  The list is posted on the Department’s publicly accessible website and is updated weekly to identify businesses that have violated the Commonwealth’s labor laws, misclassified their workers, owe unemployment compensation back taxes, or fail to carry requisite workers' compensation insurance.

My legislation would ensure that this list continues to be available to the public and updated on a regular basis.  Businesses would be removed from the list once they have resolved their violations with the Department.

My legislation would also prevent contractors or employers from applying for state contracts or grants until they are removed from the Non-Compliance List.

Pennsylvania workers should know if a company fails to uphold their end of the bargain by violating the Commonwealth’s most important wage and labor laws.

Please join me in co-sponsoring this legislation.
