MEMORANDUM

Posted: January 8, 2013 01:15 PM
From: Senator Timothy J. Solobay
To: All Senate members
Subject: Prescription Drug Donation Program

In the near future, I will be re-introducing legislation which would create the Prescription Drug Donation Program Act.

This act would establish a program under which health care facilities and pharmacies may voluntarily work together to repackage and redistribute donated drugs to community-based clinics which render health care services to the financially disadvantaged population. The drugs can be donated by any health care facility to vendor pharmacies which inspect, repackage and distribute the drugs to approved clinics. The approved clinics then dispense the drugs to patients.

This measure also sets standards for the types and process by which these drugs are donated. Entities volunteering to participate must be approved by the State Board of Pharmacy and comply with all applicable laws associated with safety and procedure. Pharmacies must also comply with inspection standards when determining the quality and legitimacy of drugs to be donated. Likewise, a set of standards are established for recipients of these prescriptions.

This legislation was SB 1218 of the 2011-12 session. Previous cosponsors include: Costa, Tartaglione, Alloway, Boscola, Browne, Ferlo, Fontana and Waugh.
