Subject: Pharmacy Benefit Manager Transparency
 
Transparency is key for any healthy, functioning market. Unfortunately, the health care market’s byzantine structure prevents patients from making informed decisions about their health.
 
Our legislation will bring a bit more transparency to one part of our health care market, pharmacy benefit managers (PBMs). Our bill will require PBMs to disclose how much money they make over cost of each prescription, and if they steer patients to certain pharmacies, which pharmacies are on their list. Further, the bill will establish a procedure for auditing PBMs by the Auditor General and require the Insurance Department to accept complaints from pharmacies about PBMs.
 
These elements combined will allow for greater public knowledge on how PBMs operate and permit those affected by PBMs—patients and pharmacies—to make informed decisions on which PBMs they wish to utilize.
