MEMORANDUM

Posted: March 31, 2023 09:29 AM
From: Representative Ed Neilson and Rep. Thomas L. Mehaffie, III
To: All House members
Subject: Charitable Designation for Fraternal Organizations

Pennsylvania and the nation have a long history of fraternal organizations with deep connections to the communities in which they operate. These organizations often fill in the gaps of government programs by providing important services to residents. Despite the invaluable work these organizations perform, they are not recognized as charities and face tax implications.

For this reason, we plan to introduce legislation amending the Purely Public Charity Act to designate certain fraternal organizations as public charities, thus relieving them of their tax burden and freeing up additional resources for the communities they serve.  To qualify, an organization must have operated in Pennsylvania for at least 100 years, operate without a liquor license, and be tax exempt under section 501(c)(8) or (10) of the Internal Revenue Code.

Fraternal organizations make meaningful changes in our communities. We must ensure their work can easily continue. Please join us in co-sponsoring this legislation.
