Subject: | Collection of Homeowner Association Fees, Dues, etc. During a Foreclosure |
In the near future, I plan to introduce legislation that would allow Homeowner Associations (HOA) greater ability in collecting delinquent HOA fees, dues, and other costs when a property has entered foreclosure. Often, when a property is nearing foreclosure, it is common for HOA fees and dues to become delinquent. Presently, Title 68 (Real and Personal Property) of the Pa C.S. allows the HOA to assess a foreclosing institution, such as a bank, for unpaid expenses, dues, and fees for the six months immediately preceding the date of the judicial sale of the property. My legislation would expand the six month look back to twelve months. In granting the full twelve months, HOAs will be better able to be made whole and square their accounts for the various services that they supply to their membership.
