Subject: | Online Privacy and Security Bill Package –Data Breach of Consumer Information by an Internet Service Provider or Telecommunications Company |
In the near future, I plan to introduce legislation that would establish standards and safeguards for Internet Service Provider (ISP) or Telecommunications Company when a data breach of customer information occurs. This bill will be a part of the Online Privacy and Security Bill package. As you know, Congress recently passed a bill that will reverse and block internet privacy rules that were passed by the Federal Communications Commission (FCC). These FCC rules were designed to protect consumers, however, this partisan reversal will now expose millions of Americans from having their personal information sold by ISPs and Telecommunication Companies to advertisers and other third parties. The General Assembly needs to take steps to protect Pennsylvanians from these invasive actions. Since Congress is allowing the collection of customer data, the General Assembly needs to require that precautions are put into place since millions of people could be exposed to a data breach. Under my bill, an Internet Service Provider or Telecommunications Company must notify its customers when a data breach of customer personal data occurs. In addition, companies must establish, implement, and maintain safeguards reasonably designed to ensure the security of personal data of its customers. We must do everything in our power to protect against the unauthorized loss, misuse, alteration, destruction, access to or use of this private information. Violations of this act shall be considered a violation of the Unfair Trade Practices and Consumer Protection Law.
