Subject: E-Verify for Private Construction Contractors and Subcontractors
 

In near future, I plan to introduce a bill that would compel all private construction contractors and subcontractors to provide evidence that their employees have been certified by the E-Verify Program (EVP) under the Department of Homeland Security in order to receive a building permit from a municipality.

Under my bill, if a contractor or subcontractor is working on a project with a value more than $25,000, they must show evidence that their employees have been E-Verified to receive the building permit for the project. If it is found that the employer has employees working on the project who have not been run through the EVP, the municipality may levy no more than a $350 fine per violation. Also, my proposal would protect any employee which reported their employer for violating this bill, or an employee who was a party to an investigation regarding their employer’s noncompliance with the provisions of this measure.

Under current law, the Commonwealth has similar E-Verify requirements for any contractor or subcontractor working on a public works project, so logically, requiring this for the private sector is the next step.
