In the near future, I plan to reintroduce former House Bill 2298 legislation that, if enacted, would amend Title 61 (Prisons and Parole) of the Pennsylvania Consolidated Statutes by creating a section to allow inmates to voluntarily donate their organs posthumously. My legislation would simply require the Pennsylvania Department of Corrections to collect information, upon intake, regarding an inmate’s desire to donate their organs if they die while in the custody of the department. The department would be required to maintain the inmate’s record of an anatomical gift determination, and would be responsible to release the information in the event of an inmate’s death.
