Subject: | Local option to provide exemption for sprinkler system in R-3 and R-4 classified buildings |
In the near future, I will introduce legislation that will allow municipalities to offer flexibility with respect to requirements for sprinkler systems in small residential facilities, such as day care facilities and personal care homes. This proposal is a further step in keeping our Commonwealth competitive by keeping government regulation up to date with the technology and building systems that are now available. Under current law, all non-grandfathered buildings classified as R-3 and R-4 occupancy structures (small facilities which provide human services for up to 16 residents) must have a functioning sprinkler system in place. However, many current building systems primarily utilize non-combustible materials and systems. Because the structures are non-combustible, structure fire is improbable by design. This proposal will alleviate this increasingly unnecessary mandate in R-3 and R-4 buildings where the materials used in construction meet stringent fire retardant standards. My bill would also allow smaller facilities to locate in rural areas not served by central water systems, giving residents more affordable options to more age in place. The exemption will be granted by the municipality either through adoption of a resolution or local referendum vote, ensuring the safety of local residents and allowing the exemption to be granted on a case-by-case basis.
