AN ACT
Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
act to consolidate, editorially revise, and codify the public
welfare laws of the Commonwealth," in public assistance,
providing for payments for spousal PERSONAL care services.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of June 13, 1967 (P.L.31, No.21), known
as the Human Services Code, is amended by adding a section to
read:
Section 443.13. Payments for Spousal PERSONAL Care
Services.-- (a) The department shall seek a waiver from the
Centers for Medicare and Medicaid Services of the United States
Department of Health and Human Services to establish a program
to provide payments to spousal caregivers for spousal care
services provided to spouses who are medical assistance

recipients FOR PERSONAL CARE SERVICES PROVIDED BY THE SPOUSE OF
A MEDICAL ASSISTANCE RECIPIENT . Upon approval of the waiver, the
department shall promulgate regulations necessary to implement
the program under this section.
(b) Upon approval of the waiver and enactment of an
appropriation to the department for the purpose of, and adequate
to fully fund, the payments under subsection (a), the department
shall promulgate regulations necessary to implement the program
under this section.
(c) The department may not make payments under subsection
(a) until the regulations under subsection (b) are promulgated.
Section 2. This act shall take effect in 60 180 days.
