Brief Description |
This amendment amends the Law and Justice Code regarding the collection and storage of DNA samples in the State DNA Databank, and the analysis of samples to extract forensic DNA profiles and store them in the State DNA Database for comparison to others in criminal investigations.
Currently, DNA identification samples are to be collected from criminal defendants upon conviction or adjudication of delinquency for felonies and certain misdemeanor sex offenses. The amendment expands DNA collection to those who are convicted of a misdemeanor of the first degree and certain crimes classified as a misdemeanor of the second degree.
This amendment is substantively the same as two bills considered earlier this session by the committee: HB 1523 (Marsico), which passed this committee by a vote of 26-0, and SB 641 (Killion), which passed this committee by a vote of 25-2.
