Brief Description |
The amendment: (1) maintains the current law about federal offenses triggering forfeiture if the crime is “substantially the same” as the Commonwealth offense; (2) adds the offenses in another state as offenses which, if committed through public office or employment, trigger forfeiture so long as the other state’s offenses are “substantially the same” as the Commonwealth offense; (3) adds the federal offenses of conspiracy to commit an offense against the United States and frauds and swindles to those offenses which trigger forfeiture [the so-called Sen. Mellow offenses]; and (4) provides that AOPC provide the data to SERS and PSERS so that the pension can be cut off when the guilty plea is entered or when guilt is found by a jury.
[AOPC has been working with SERS and PSERS for some months to provide data about cases so that SERS and PSERS can find defendants who should lose their pensions. AOPC anticipates that, if SB 611 becomes law, it will expand the data given to SERS and PSERS so that these pension systems can find defendants.]
