A performing arts facility that applies for a license may not be denied a license as a result of sharing facility space with a nonaffiliated entity if: 1. the applicant is owned and operated by a Pennsylvania State System of Higher Education university 2. the performing arts facility is located in a city of the third class 3. the nonaffiliated entity is a not-for-profit organization 4. the use of the shared facility space is donated by the applicant to the nonaffiliated entity
