This amendment will confine the appointment of a special prosecutor to those instances where the Attorney General himself or herself is the subject of the investigation or prosecution. In cases where the Attorney General is not a subject, but has a personal or professional conflict of interest to investigate or prosecute, including that the subject is an OAG employee, the amendment will establish a mechanism in the Commonwealth Attorneys Act to transfer the matter to a district attorney with jurisdiction to investigate or prosecute.
