This amendment treats the exception for conservation easements fairly by restricting the exemption to those land trust entities provided for in existing state laws and by qualifying that the trust has been in existence for at least two years. Also, the amendment makes a technical change making anyone who records or enters into agreement to impose a private transfer fee may be liable for damages and fees.
