AN ACT
Amending the act of June 3, 1937 (P.L.1333, No.320), entitled
"An act concerning elections, including general, municipal,
special and primary elections, the nomination of candidates,
primary and election expenses and election contests; creating
and defining membership of county boards of elections;
imposing duties upon the Secretary of the Commonwealth,
courts, county boards of elections, county commissioners;
imposing penalties for violation of the act, and codifying,
revising and consolidating the laws relating thereto; and
repealing certain acts and parts of acts relating to
elections," in ballots, providing for number of emergency
ballots to be printed.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of June 3, 1937 (P.L.1333, No.320), known
as the Pennsylvania Election Code, is amended by adding a
section to read:
Section 1007.1. Number of Emergency Ballots to be Printed.--
In a county that utilizes an electronic voting system with a
ballot-marking method of operation, or in which the ballot used
by the electronic voting system cannot be used by an elector for
voting without the use of a properly functioning electronic
voting system, the county shall print and supply each election

district with a number of emergency ballots equal to the ballot
requirements under section 1007. Emergency ballots shall be
suitable for an elector to vote without the use of an electronic
voting machine. Where a paper ballot typically used with an
electronic voting system is suitable to be voted by an elector
without the use of an electronic voting system, such ballot may
be used as an emergency ballot in the case that an electronic
voting machine is not properly functioning.
Section 2. This act shall take effect in 60 days.
