AN ACT
Amending Title 53 (Municipalities Generally) of the Pennsylvania
Consolidated Statutes, providing for Public Facilities
Infrastructure Grant Program.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 53 of the Pennsylvania Consolidated
Statutes is amended by adding a chapter to read:

§ 6301. Definitions.

The following words and phrases when used in this chapter
shall have the meanings given to them in this section unless the
context clearly indicates otherwise:
"Department." The Department of Community and Economic
Development of the Commonwealth.
"Eligible applicant." A municipality or local library.
"Grant program." The Public Facilities Infrastructure Grant
Program established under section 6302 (relating to grant
program).
"Local library." Any free, public, nonsectarian library,
whether established and maintained by a municipality or by a
private association, corporation or group, which serves the
informational, educational and recreational needs of all the
residents of the area for which the governing body is
responsible.
"Municipality." A county, city, borough, incorporated town
or township or home rule municipality.
"Public facility." A public building, structure, facility,
land or waterway used for a recreational purpose, including a
playground, swimming facility, athletic field, court,
maintenance building, recreational center or environmental
center.
§ 6302. Grant program.
(a) Establishment.--The Public Facilities Infrastructure
Grant Program is established as a competitive grant program
within the department.
(b) Use of grants.--Money awarded under the grant program
shall be used for the maintenance, repair, renovation or
reconstruction of a building or public facility owned by a
municipality or local library.

(c) Department powers and duties.--The department shall:
(1) Within 180 days of the effective date of this
paragraph, establish guidelines necessary to award grants
under this chapter.
(2) Award grants under the grant program in accordance
with this chapter to eligible applicants for uses provided
under subsection (b).
(3) Determine the form and manner by which applicants
may apply for a grant under section 6306 (relating to
administration) and post the information on the department's
publicly accessible Internet website.
(d) Compliance with Pennsylvania Prevailing Wage Act.--The
maintenance, repair, renovation or reconstruction of a building
or public facility using money awarded under the grant program
shall be done in compliance with the act of August 15, 1961
(P.L.987, No.442), known as the Pennsylvania Prevailing Wage
Act.
§ 6303. Funding.
The General Assembly shall appropriate money to the
department from the General Fund for the purpose of awarding
grants under this chapter.
§ 6304. Plan.
Within 90 days of the effective date of this section and each
March 15 thereafter, the department shall adopt a plan which
establishes the department's priorities for that year and
describes the method in which grant program money will be
distributed that year.
§ 6305. Reporting.
The following apply:
(1) Within 90 days of the close of the first calendar

year after the effective date of this paragraph and by each
July 1 thereafter, the department shall issue a report
containing a financial statement, an itemized list of
projects funded and a description of other expenditures in
the preceding calendar year.
(2) The report shall be submitted to the Governor, the
Auditor General, the chair and minority chair of the Local
Government Committee of the Senate and the chair and minority
chair of the Local Government Committee of the House of
Representatives and published on the department's publicly
accessible Internet website.
(3) The report shall be a public record.
§ 6306. Administration.
(a) Applications.--An application for a grant under this
chapter shall be submitted by an eligible applicant in the form
and manner prescribed by the department.
(b) Review process.--
(1) The department shall review applications and make
awards subject to subsection (c).
(2) The department shall consider the geographical
distribution of money to ensure that all areas of this
Commonwealth participate to the greatest extent possible.
(3) An eligible applicant may revise and resubmit a
denied application to the department.
(c) Allocation.--An eligible applicant may not receive more
than $750,000 in a fiscal year.
(d) Limitation.--The department may only award a grant to an
eligible applicant that provides matching funds equal to at
least 50% of the amount awarded.
Section 2. This act shall take effect in 60 days.
