AN ACT
Providing for crematory regulation.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Short title.
This act shall be known and may be cited as the Crematory
Regulation Act.
Section 2. Definitions.
The following words and phrases when used in this act shall
have the meanings given to them in this section unless the
context clearly indicates otherwise:
"Crematory incinerator." A furnace or apparatus for burning
animal or human remains to bone fragments.
"Department." The Department of Environmental Protection of
the Commonwealth.
Section 3. Work practice standards.
Crematories for which construction commenced after April 17,

1989, shall comply with the following work practice standards:
(1) The crematory incinerator shall provide an interlock
system that precludes charging of the primary chamber until
the secondary or last chamber exit temperature is established
and holding at 1600 degrees Fahrenheit.
(2) Operators may open the charge door during the
cremation cycle for short periods of time to inspect or
reposition the remains.
(3) The department shall not require in a general plan
approval or a general permit for operation of a crematory
incinerator a temperature greater than 1600 degrees
Fahrenheit.
Section 4. Monitoring requirements.
(a) Requirements.--The temperature at which a crematory
incinerator is operated shall be monitored.
(b) Standards.--Monitoring shall be conducted in accordance
with regulations adopted by the department.
Section 5. Applicability.
This act applies to a crematory incinerator for which
construction commenced after April 17, 1989.
Section 6. Effective date.
This act shall take effect in 60 days.
