AN ACT
Amending Titles 18 (Crimes and Offenses), 30 (Fish), 34 (Game)
and 75 (Vehicles) of the Pennsylvania Consolidated Statutes,
in other offenses, further providing for violation of rules
regarding conduct on Commonwealth property; in protection of
property and waters, further providing for the offense of
littering; in protection of property and persons, further
providing for the offense of littering and restrictions on
vehicles; and, in size, weight and load, further providing
for securing loads in vehicles.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 7506(b) of Title 18 of the Pennsylvania
Consolidated Statutes is amended to read:
§ 7506. Violation of rules regarding conduct on Commonwealth
property.

(b) Violation penalty.--A person who violates any of the
rules and regulations promulgated pursuant to this section is
guilty of a summary offense[.] and, in addition to any other
penalty that may be imposed, may be required to pick up litter
or illegally dumped trash.

Section 2. Section 2503(c) of Title 30 is amended to read:
§ 2503. Littering.

(c) Penalty.--Any person who deposits or otherwise disposes
of a thing or substance in violation of this section which
causes or may cause damage to, or destruction of, fish commits a
summary offense of the first degree. Any person who transports
household refuse or garbage from another location and disposes
of it by leaving it on lands or waters open to fishing or
boating commits a summary offense of the second degree. Any
person who otherwise violates this section commits a summary
offense of the third degree. In addition to the penalties set
forth in section 923 (relating to classification of offenses and
penalties), an additional penalty of not less than $20 nor more
than $50 for each item or piece of litter thrown, discarded,
left, emitted or deposited in violation of this section may be
imposed on any person who is convicted or acknowledges guilt of
a violation of this section. In addition to the penalties under
section 923, a person who is convicted or acknowledges guilt of
a violation of this section [shall]:
( 1) Shall be liable to pay, upon demand of the person
having legal control of the land or water, a sum equal to the
cost of disposal of the discarded item.
(2) May be required to pick up litter or illegally
dumped trash.
Section 3. Section 2510(b)(3) of Title 34 is amended to
read:
§ 2510. Littering and restrictions on vehicles.

(b) Penalties.--

(3) In addition to the fine imposed by section 925
(relating to jurisdiction and penalties)[, an]:
(i) An additional fine of $10 may be imposed for
each item of litter thrown, discarded, left, emitted or
deposited in violation of this section.
(ii) A person may be required to pick up litter or
illegally dumped trash.

Section 4. Section 4903(g) of Title 75 is amended to read:
§ 4903. Securing loads in vehicles.

(g) Penalty for violation of subsection (c.1) or (c.2).--A
person who owns or who operates a vehicle in violation of
subsection (c.1) or (c.2) commits a summary offense and shall,
upon conviction, be sentenced to pay a fine of not less than
$300 nor more than $1,000. Upon conviction, a person may also be
required to pick up litter or illegally dumped trash.
Notwithstanding the provisions of 42 Pa.C.S. §§ 3571 (relating
to Commonwealth portion of fines, etc.) and 3573 (relating to
municipal corporation portion of fines, etc.), disposition of
any fine collected for a violation of subsection (c.1) or (c.2)
shall be as follows:
(1) Unless paragraph (2) applies, the fine collected
shall be paid to the Commonwealth for deposit into the Motor
License Fund.
(2) If the county where the offense was committed has a
litter control program approved by the department, 50% of the
fine collected shall be paid to the county for expenditure in
the approved litter control program; and 50% of the fine

collected shall be paid to the Commonwealth for deposit into
the Motor License Fund.
Section 5. This act shall take effect in 60 days.
