AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in miscellaneous provisions relating
to institutions of higher education, providing for human
trafficking prevention and education programs.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of March 10, 1949 (P.L.30, No.14), known
as the Public School Code of 1949, is amended by adding a
section to read:
Section 2004-I. Human trafficking prevention and education
programs.
(a) Duty to provide.--An institution of higher education
shall provide first-year students voluntary access to at least
three in-depth prevention and education programs regarding human
trafficking at any time during the school year, including during
new student orientation activities.
(b) Program materials.--An institution of higher education

shall provide program materials relating to the human
trafficking prevention and education programs at no cost to
participating students and may utilize program materials offered
by a nonprofit organization that specializes in outreach and
education programs on human trafficking.
(c) Specific subject matter.--The human trafficking
prevention and education programs shall specifically provide
students the following:
(1) Definitions and nature of human trafficking.
(2) Current Federal and State laws relating to human
trafficking.
(3) Facts and statistics on human trafficking in this
Commonwealth and throughout the United States.
(4) How human traffickers profile victims.
(5) The role of online computer activity.
(6) How demand is created and the industries that
influence human trafficking.
(7) How to identify a potential victim and what to do
when a victim is identified.
(8) An understanding of force, fraud and coercion.
(9) An understanding of how traffickers groom a victim.
(10) The differences between prostitution, sex
trafficking and exploitation.
(11) The role that pornography plays in sexual
exploitation and human trafficking.
(12) An understanding of the complexities of abuse,
indoctrination and manipulation.
(13) An understanding of the physiological makeup of a
human trafficking victim.
(14) How victims of human trafficking are rescued.

(15) How individuals may engage in activities aimed to
prevent human trafficking.
(d) Annual attestation of compliance.--An institution of
higher education shall report to the department on the
implementation of the human trafficking prevention and education
program through an annual attestation of compliance to the
department.
(e) Definitions.--As used in this section, the following
words and phrases shall have the meanings given to them in this
subsection unless the context clearly indicates otherwise:
"Department." The Department of Education of the
Commonwealth.
"Human trafficking." An activity in violation of 18 Pa.C.S.
§ 3011 (relating to trafficking in individuals) either alone or
in conjunction with an activity in violation of 18 Pa.C.S. §
3012 (relating to involuntary servitude).
"Institution of higher education." Any of the following:
(1) A community college operating under Article XIX-A.
(2) A rural regional college established under Article
XIX-G.
(3) A university within the State System of Higher
Education under Article XX-A.
(4) A State-related institution as defined in section
2001-C.
(5) The Thaddeus Stevens College of Technology.
(6) The Pennsylvania College of Technology.
(7) An institution of higher education located in and
incorporated or chartered by the Commonwealth and entitled to
confer degrees as provided under 24 Pa.C.S. § 6505 (relating
to power to confer degrees) and as provided for by the

standards and qualifications prescribed by the State Board of
Education under 24 Pa.C.S. Ch. 65 (relating to private
colleges, universities and seminaries).
Section 2. This act shall take effect in 60 days.
