AN ACT
Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
Statutes, in fees, further providing for fee for local use.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 1935(d) of Title 75 of the Pennsylvania
Consolidated Statutes is amended and the section is amended by
adding a subsection to read:
ยง 1935. Fee for local use.

(d) Distribution.--Money paid into the Fee for Local Use
Fund shall be distributed by the department to each
participating county in accordance with the amounts collected
from the county. [Funds] As the county elects by ordinance,
money payable to a county under this section [shall be] may be:
(1) added to [funds] money payable to the county under
section 9010(b) (relating to disposition and use of tax) and
shall be used by the county for transportation purposes [or
be];

(2) allocated by the county in accordance with section
9010(c)[.]; or
(3) used for EMS services within the county.
(e) Definition.--As used in this section, the term "EMS
services" means a career, nonprofit or volunteer entity that
engages in the business or service of providing emergency
medical services to patients within this Commonwealth by
operating any of the following:
(1) An ambulance.
(2) An advanced life support squad vehicle.
(3) A basic life support squad vehicle.
(4) A quick response service.
(5) A special operations emergency medical service. This
paragraph includes, but is not limited to:
(i) a tactical EMS service;
(ii) a wilderness EMS service;
(iii) a mass-gathering EMS service; and
(iv) an urban search and rescue EMS service.
(6) A vehicle or service which provides emergency
medical services outside of a health care facility, as
prescribed by the Department of Health by regulation.
Section 2. This act shall take effect in 60 days.
