AN ACT
Amending Title 18 (Crimes and Offenses) of the Pennsylvania
Consolidated Statutes, in other offenses, providing for drug
trafficking near a drug and alcohol recovery house.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 18 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
ยง 7508.3. Drug trafficking near a drug and alcohol recovery
house.
(a) Offense defined.--A person commits the offense of drug
trafficking near a drug and alcohol recovery house if the person
manufactures, delivers or possesses with the intent to
manufacture or deliver a controlled substance within 1,000 feet
of the real property on which a drug and alcohol recovery house
is located.
(b) Grading.--An offense under this section constitutes a
felony.
(c) Definitions.--As used in this section, the following

words and phrases shall have the meanings given to them in this
subsection unless the context clearly indicates otherwise:
"Controlled substance." A Schedule II, III or IV controlled
substance as defined in the act of April 14, 1972 (P.L.233,
No.64), known as The Controlled Substance, Drug, Device and
Cosmetic Act.
"Drug and alcohol recovery house." As defined in section
2311-A of the act of April 9, 1929 (P.L.177, No.175), known as
The Administrative Code of 1929.
Section 2. This act shall take effect in 60 days.
