AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in reimbursement by Commonwealth and
between school districts, providing for level-up supplemental
basic education funding for the 2021-2022 school year.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of March 10, 1949 (P.L.30, No.14), known
as the Public School Code of 1949, is amended by adding a
section to read:
Section 2502.55. Level-up Supplemental Basic Education
Funding for the 2021-2022 School Year.--(a) From money
appropriated for payment of basic education funding to school
districts in the 2022-2023 fiscal year, the Commonwealth shall
pay to qualifying school districts an allocation for the 2021-
2022 school year payable in the 2022-2023 fiscal year as
follows:
(1) There shall be a determination of the qualifying school

districts with an amount less than or equal to the amount that
represents the twentieth percentile for all school districts.
For each of the five preceding school years, the determination
shall be calculated as follows:
(i) For each school district, the sum of the amount of
student weights calculated under section 2502.53(c)(1)(ii),
(iii), (iv), (v) and (vi) and the amount of weighted special
education headcounts calculated under section 2509.5(bbb)(2)(i).
(ii) For each school district, divide the current
expenditures by the sum calculated for the school district in
subparagraph (i).
(iii) For each school district, calculate the average of the
quotients calculated under subparagraph (ii).
(2) Qualifying school districts determined under paragraph
(1) shall receive an amount calculated as follows:
(i) For each qualifying school district, multiply the
product in section 2502.53(b)(2)(i) for the 2021-2022 school
year by three hundred million dollars ($300,000,000).
(ii) Divide the product in subparagraph (i) by the sum of
the products in section 2502.53(b)(2)(i) for the 2021-2022
school year for all qualifying school districts.
(b) Payments made under this section shall be deemed to be
part of the school district's allocation amount under section
2502.53(b)(1) for the 2022-2023 school year and each school year
thereafter.
(c) The provisions of sections 2502.53 and 2509.5 shall
apply to the calculation of the respective factors in this
section.
Section 2. This act shall take effect in 60 days.
