AN ACT
Amending the act of June 29, 1953 (P.L.304, No.66), entitled "An
act providing for the administration of a statewide system of
vital statistics; prescribing the functions of the State
Department of Health, the State Advisory Health Board and
local registrars; imposing duties upon coroners,
prothonotaries, clerks of orphans' court, physicians,
midwives and other persons; requiring reports and
certificates for the registration of vital statistics;
regulating the disposition of dead bodies; limiting the
disclosure of records; prescribing the sufficiency of vital
statistics records as evidence; prescribing fees and
penalties; and revising and consolidating the laws relating
thereto," in general provisions, further providing for
definitions; and, in records, further providing for
disclosure to governmental agencies.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 105 of the act of June 29, 1953 (P.L.304,
No.66), known as the Vital Statistics Law of 1953, is amended by
adding definitions to read:
Section 105. General Provisions: Definitions.--As used in
this act--

(13) "Conduct of official duty" means tasks, actions or

responsibilities performed to facilitate the achievement of
an agency's authorized work.
(14) "Legislative service agency" means a bipartisan,
bicameral agency created by statute for the use and
information of the Governor, members of the General Assembly
and the heads of the departments of the State government,
including the Capitol Preservation Committee, the Center for
Rural Pennsylvania, the Independent Fiscal Office, the Joint
State Government Commission, the Legislative Budget and
Finance Committee, the Legislative Data Processing Center,
the Local Government Commission and the Pennsylvania
Commission on Sentencing or any other bipartisan, bicameral
agency created or authorized by the General Assembly to
provide a legislative service.
(15) "Research" means the systematic investigation into
and study of materials and sources to establish facts and
reach new conclusions.
(16) "State agencies of Government" means any agency of
the Commonwealth, including a legislative service agency.
Section 2. Section 806 of the act is amended to read:
Section 806. Records: Disclosure to Governmental Agencies.--
The department [may] shall disclose information or data from
vital statistics record to federal, state or municipal agencies
of government which request such information or data in the
interest of conduct of official duty.
Section 3. This act shall take effect in 60 days.
