AN ACT
Amending the act of March 4, 1971 (P.L.6, No.2), entitled "An
act relating to tax reform and State taxation by codifying
and enumerating certain subjects of taxation and imposing
taxes thereon; providing procedures for the payment,
collection, administration and enforcement thereof; providing
for tax credits in certain cases; conferring powers and
imposing duties upon the Department of Revenue, certain
employers, fiduciaries, individuals, persons, corporations
and other entities; prescribing crimes, offenses and
penalties;" in fireworks, further providing for use of
consumer fireworks and for penalties.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 2404 of the act of March 4, 1971 (P.L.6,
No.2), known as the Tax Reform Code of 1971, is amended by
adding a subsection to read:
Section 2404. Use of consumer fireworks.

(c) Time and day prohibitions.--
(1) Except as provided in paragraphs (2) and (3), a
person may not intentionally use consumer fireworks between
the hours of 11 p.m. and 10 a.m.

(2) On July 2, 3 and 4 and December 31, a person may use
consumer fireworks until 1 a.m the following day.
(3) If July 4 falls on a Tuesday, Wednesday or Thursday,
a person may use consumer fireworks until 1 a.m. on the
immediately preceding and following Friday and Saturday.
Section 2. Section 2414(1) of the act is amended to read:
Section 2414. Penalties.
The following shall apply:
(1) A person using consumer fireworks in violation of
the provisions of this article commits a summary offense and,
upon conviction, shall be punished [by a fine of not more
than $100.] as follows:
(i) For a first offense, by a fine of not more than
$1,000.
(ii) For a second offense, by a fine of not more
than $2,500.
(iii) For a third or subsequent offense, by a fine
of not more than $5,000.

Section 3. This act shall take effect in 60 days.
