AN ACT
Amending the act of June 3, 1919 (P.L.366, No.179), entitled "An
act reorganizing the Department of State Police; creating
therein a Bureau of Fire Protection; providing for a State
Police Force, and defining the powers and duties of the same,
including the enforcement of laws relating to game, fish,
forestry, and water supply, and certain other laws, and
including the collection of information useful for the
detection of crime, and the apprehension of criminals;
providing for the equipment, maintenance, and transportation
of such police; providing for barracks and substations
therefor; and prescribing penalties," further providing for
the Commissioner of Pennsylvania State Police.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 7 of the act of June 3, 1919 (P.L.366,
No.179), entitled "An act reorganizing the Department of State
Police; creating therein a Bureau of Fire Protection; providing
for a State Police Force, and defining the powers and duties of
the same, including the enforcement of laws relating to game,
fish, forestry, and water supply, and certain other laws, and
including the collection of information useful for the detection
of crime, and the apprehension of criminals; providing for the
equipment, maintenance, and transportation of such police;

providing for barracks and substations therefor; and prescribing
penalties," is amended to read:
Section 7. (a) The [Superintendent] Commissioner of [the]
Pennsylvania State Police shall be appointed by the Governor for
a term of four years from the third Tuesday of January next
following the election of a Governor and until his successor
shall have been appointed and qualified. The [officers and
enlisted men] enlisted members of the State Police [Force shall
receive an increase of one hundred and twenty dollars per annum
after one year's service, and an additional increase of one
hundred and twenty dollars per annum during continuous service
for each of the following three years, and an additional
increase of sixty dollars per annum during continuous service
for each of the following two years:] shall be paid as
prescribed by law: Provided, That this section shall not apply
to the [Superintendent] Commissioner of [the] Pennsylvania State
Police and the deputies, chiefs, statisticians, clerks, experts,
and other assistants engaged in the work of the Pennsylvania
State Police who are not enlisted members of the State Police
Force, and whose compensation under existing law is fixed by the
[Superintendent] Commissioner of [the] Pennsylvania State Police
with the approval of the Governor.
(b) The Commissioner and deputies shall be qualified by
training and experience to perform the duties of the office. No
Commissioner or deputy may be appointed who has not served at
least ten years as a certified law enforcement officer employed
by any of the following:
(1) The Pennsylvania State Police.
(2) A police department requiring certification under 53
Pa.C.S. Ch. 21 Subch. D (relating to municipal police education

and training).
(3) A law enforcement agency of the Federal Government.
(4) A law enforcement agency of another state where the
qualifications for certification are equivalent to, or greater
than, those required in this Commonwealth.
(c) The required service under subsection (b) may be
cumulative and shall include at least five years of service in a
position of supervision over other law enforcement officers.
(d) Prior to receiving authorization to access criminal
history record information maintained by the Pennsylvania State
Police or any other criminal justice agency, the Commissioner
and deputies shall be trained under 18 Pa.C.S. Ch. 91 Subch. D
(relating to security).
Section 2. This act shall take effect in 60 days.
