AN ACT
Amending the act of June 24, 1968 (P.L.237, No.111), entitled
"An act specifically authorizing collective bargaining
between policemen and firemen and their public employers;
providing for arbitration in order to settle disputes, and
requiring compliance with collective bargaining agreements
and findings of arbitrators," providing for notice to public
prior to collective bargaining.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of June 24, 1968 (P.L.237, No.111),
referred to as the Policemen and Firemen Collective Bargaining
Act, is amended by adding a section to read:
Section 3.1. (a) The following shall apply:
(1) A public employer may elect to require notice to the
public prior to the beginning of collective bargaining under
section 3. The following shall apply:
(i) For a public employer serving a single political
subdivision, the governing body of the political subdivision may
adopt an ordinance to require public notice under this section
and hold a public hearing with public comment on the forthcoming

collective bargaining. The public hearing shall be held 90 days
prior to the beginning of collective bargaining and shall be
publicized on the employer's publicly accessible Internet
website 14 days prior to the hearing.
(ii) For a public employer serving multiple political
subdivisions, the governing body that controls the public
employer, including a board or commission established by the
participating political subdivisions, may adopt a resolution to
require public notice under this section. If there is no
governing body that controls the public employer, the governing
bodies of the participating political subdivisions may all adopt
ordinances to require public notice under this section. The
governing bodies of the participating political subdivisions may
also hold hearings with public comment on the forthcoming
collective bargaining. The public hearing shall be held 90 days
prior to the beginning of collective bargaining and shall be
publicized on the employer's publicly accessible Internet
website 14 days prior to the hearing.
(2) An agency, authority or instrumentality of the
Commonwealth shall provide public notice under this section.
(b) A public employer that provides a hearing under
subsection (a) shall accept written public comments on
forthcoming collective bargaining negotiations prior to the
scheduled public hearing. The following shall apply:
(1) The written public comment period shall begin five
business days after the posting or publication under section
(1).
(2) The written public comment period shall be not less than
two weeks or ten business days, whichever is longer.
Section 2. This act shall take effect in 60 days.
